TERMS AND CONDITIONS

Discovery Travel Ltd Contract with You


Discovery Travel Ltd wish to set out clearly the mutual obligations and responsibilities between us when a contract is entered into.  A contract will exist as soon as Discovery Travel Ltd confirms your booking. 

Payment Full payment is required to confirm any booking. We accept Visa, Mastercard, American Express, and cash as payment.   Any prices advertised on our website, and in email quotations, are cash prices, are in New Zealand Dollars, and include GST (sales tax).  A transaction fee of 3.45% applies to all payments by credit card.  International bank to bank payments (telegraphic transfers) can be accepted, however a NZ$30 fee applies to accept this payment type. 
Private Day Tour Cancellations  Any tour cancelled within 14 days of tour departure, and 'no shows' incurs a 100% cancellation fee.  Tours cancelled where more than 14 days notice has been given to cancel, are fully refundable, apart from tours which include the TranzAlpine Train.  This portion of your tour cost (the cost of the TranzAlpine Train) is non-refundable. 

Individual cancellation policies apply to Private Charters, Cruise Ship Tours, Concert and Festival Bookings You will be notified of our policies prior to booking.  

Insurance Discovery Travel Ltd strongly recommends that you arrange comprehensive travel insurance at the time you book your trip.  
Refunds No refunds will be made on any un-used or partially-used sections of your itinerary once travel has commenced, except in extenuating circumstances. Your own travel insurance may provide cover. Discovery Travel Ltd will not be liable for any refunds for un-used or partially-used travel, arising from the unlikely need to change any arrangements, to ensure the safety and/or further participation and enjoyment of your holiday.
Cancellations or Changes by Discovery Travel Ltd While it is unlikely that Discovery Travel Ltd will need to make any changes to your confirmed itinerary, sometimes this is unavoidable.  Accordingly, notwithstanding anything otherwise provided in this Agreement, Discovery Travel Ltd reserves the right to, amend itineraries, or to cancel arrangements, in the event that it is required to do so, as a result of circumstances arising outside of its control.  Discovery Travel Ltd will make alternative arrangements,  to a similar value, when it is reasonably practical to do so. 
Itinerary Changes In the event that itineraries require alteration as a result of weather, transport cancellation or delays, or any other factors beyond Discovery Travel Ltd direct control, no liability will be accepted by Discovery Travel Ltd for any additional expenses incurred.
Photos 
Photos may be taken for promotional purposes.  Please advise if you do not wish for photos to be used for promotional purposes.

Force Majeure Compensation will not be payable by Discovery Travel Ltd if it needs to cancel or change your travel arrangements in any way for reasons of war, threat of war, riot, civil strife, industrial dispute, terrorist action, natural or nuclear disaster, fire, adverse weather conditions or other circumstances amounting to force majeure in law.
Liability Discovery Travel Ltd will not be liable for any loss or damage to luggage or personal effects.  Discovery Travel Ltd will not be liable for any personal injury or death to a passenger arising whilst traveling with Discovery Travel Ltd or any of its nominated suppliers.  Some of the activities listed as options or included in tours involve an element of risk.  Discovery Travel Ltd gives notice that it will not be liable for any damage, personal injury or death arising as a result of any of those activities.

Law and Jurisdiction Any matters arising in relation to your contract with Discovery Travel Ltd will be governed by New Zealand law, and subject to the jurisdiction of the Courts of New Zealand.
